Terms and conditions for using tapdub
1. Acceptance of Terms
By accessing and using tapdub (the "Service"), including our website and mobile applications (iOS/Android), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service.
These Terms apply to all users of the Service, whether accessing via our website or mobile applications.
2. Service Description
tapdub is a habit tracking and activity logging platform that allows users to:
- Create activity categories ("Dubs")
- Log individual events ("Tabs") with optional photos, text, timestamps, and location data
- Track personal habits and activities over time
- Share activities with other users (optional)
3. Eligibility
You must be at least 13 years of age to use tapdub. By using the Service, you represent and warrant that you meet this age requirement.
4. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activities that occur under your account
- Choose a username that complies with our guidelines (3-30 characters, alphanumeric and underscore only)
5. User Content and Conduct
You are solely responsible for all content you create, upload, or share through the Service, including:
- Activity logs (Tabs)
- Photos and media
- Text descriptions and stories
- Profile information
You agree not to use the Service to:
- Post content that is illegal, harmful, threatening, abusive, or otherwise objectionable
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Harass, abuse, or harm other users
- Upload viruses, malware, or other malicious code
- Attempt to gain unauthorized access to our systems
- Use automated systems (bots, scrapers) without our permission
6. Intellectual Property
The Service, including its design, features, graphics, and code, is owned by Fruity Pages and protected by copyright and other intellectual property laws. You retain ownership of content you create, but grant us a license to use, display, and distribute it as necessary to operate the Service.
7. DISCLAIMER OF WARRANTIES - SERVICE PROVIDED "AS IS"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We make no guarantees regarding:
- Availability or uptime of the Service
- Accuracy, reliability, or completeness of data
- Data preservation or backup
- Error-free or uninterrupted operation
- Security against unauthorized access
- Compatibility with your devices or software
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRUITY PAGES SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:
- Loss of data, including activity logs, photos, streaks, or any user content
- Loss of revenue, profits, or business opportunities
- Service interruptions, outages, or technical problems
- Data breaches or unauthorized access to your account
- Bugs, errors, or software defects
- Server failures or data loss
- Any indirect, incidental, special, or consequential damages
This limitation applies regardless of the cause of action, whether in contract, tort, negligence, or otherwise, even if we have been advised of the possibility of such damages.
We strongly recommend maintaining your own backups of any important data.
9. SERVER DEPENDENCY AND SERVICE AVAILABILITY
IMPORTANT: THE TAPDUB APPLICATION REQUIRES AN ACTIVE CONNECTION TO OUR SERVERS TO FUNCTION.
You explicitly acknowledge and accept that:
- The mobile application and all features depend entirely on the availability of our backend servers for data synchronization and operation
- If our servers are unavailable for any reason, the application will be temporarily or permanently unusable
- Server outages, maintenance periods, technical failures, or complete service discontinuation can occur at any time without prior notice
- We provide no guarantee of server uptime, availability, or continuous operation
- We are under no obligation to maintain, operate, or restore server infrastructure
- In the event of permanent service discontinuation, your data may be irretrievably lost
By using tapdub, you expressly waive any and all claims against Fruity Pages arising from server unavailability, data loss due to server issues, or service discontinuation.
We recommend not relying on tapdub as your sole method of tracking critical data and maintaining independent records where appropriate.
10. Service Modifications and Termination
We reserve the right to:
- Modify, suspend, or discontinue the Service (or any part thereof) at any time
- Change these Terms at any time (we will notify users of material changes)
- Terminate or suspend your account for violations of these Terms
- Remove or modify user content at our discretion
You may terminate your account at any time through the app settings or by contacting support@tapdub.com.
11. Data Deletion Policy
Please note the following limitations regarding content deletion:
- Activity logs (Tabs) can only be deleted within 15 minutes of creation
- After 15 minutes, Tabs become permanent and cannot be deleted
- Account deletion will remove all associated data permanently
12. Third-Party Services
The mobile app may integrate with third-party services:
- Social login providers (Google, Apple)
- App distribution platforms (Apple App Store, Google Play Store)
Your use of these third-party services is governed by their respective terms and privacy policies.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
